Efficient Hosting Consultant (d.b.a. eHosting411)

These Terms of Service (“Terms”) govern your use of the hosting, domain registration, and related services (“Services”) provided by Efficient Hosting Consultant (d.b.a. eHosting411) (“we,” “our,” “us”). By purchasing, accessing, or using our Services, you agree to be bound by these Terms.
We operate as an authorized HostGator Reseller under the Aluminum Plan. While we manage customer accounts, the underlying infrastructure, datacenters, and core network operations are provided by HostGator LLC.
You must be at least 18 years old or have legal parental/guardian consent.
You must provide accurate, current, and complete information during signup and maintain it thereafter.
Accounts are non-transferable without our written consent.
Our Services include:
Web hosting using HostGator’s infrastructure.
Domain name registration and management.
Optional SSL certificates and related add-ons.
Basic technical support for account setup, configuration, and hosting issues.
We do not control HostGator’s network maintenance schedules, datacenter operations, or hardware-level performance.
You agree not to use our Services to:
Host, transmit, or link to illegal, infringing, or harmful content.
Distribute malware, engage in phishing, or send unsolicited bulk messages (“spam”).
Violate intellectual property rights.
Engage in activities that disrupt or overload the network.
We enforce HostGator’s AUP (https://www.hostgator.com/legal/acceptable-use-policy) in addition to our own.
You must comply with the following limits:
Disk Space: 60 GB total allocation.
Bandwidth: 600 GB/month.
Inodes: Max 250,000 per cPanel account.
CPU Usage: No more than 25% of CPU resources for longer than 90 seconds.
MySQL Connections: Max 25 concurrent.
MySQL Database Size: Max 1 GB per database.
Email Sending: Max 500 emails/hour per domain.
Exceeding these limits may result in account throttling, suspension, or termination.
We extend HostGator’s 99.9% uptime guarantee.
Downtime credits follow HostGator’s SLA process and must be requested within 30 days of the incident.
Scheduled maintenance and force majeure events are excluded.
All fees are due in advance unless otherwise agreed.
Payment methods: Credit card, PayPal, or other approved processors.
Non-payment may result in suspension or permanent account termination.
Domain registrations, SSL certificates, and third-party services are non-refundable once activated.
HostGator may provide weekly backups for accounts under 20 GB and 100,000 inodes.
We do not guarantee the completeness, frequency, or availability of backups.
You are responsible for maintaining your own backups.
While we take reasonable steps to protect your data, no system is 100% secure. You acknowledge that you assume all risk of data loss.
We may suspend or terminate Services immediately for:
Violation of these Terms or AUP.
Non-payment.
Activities that jeopardize network integrity or other customers.
Our total liability for all claims related to the Services will not exceed the amount paid by you in the 12 months preceding the claim.
You agree to indemnify and hold harmless Efficient Hosting Consultant (d.b.a. eHosting411), its affiliates, and its suppliers (including HostGator) from claims, damages, or expenses arising from your use of the Services.
We comply with GDPR, CCPA, and PIPEDA for handling personal data.
These Terms are governed by the laws of Alberta, Canada, without regard to conflicts of law.
